DATE: 28TH FEBRUARY, 2024 P.C.:- 1] The challenge raised in this writ petition is to the interim order passed by the Maharashtra Administrative Tribunal in the Original Application that was preferred by the Petitioners wherein challenge was raised to Rule 9(b)(ii) of the Recruitment Rules dated 06/09/2023. The Petitioners are concerned with the post of Principal/Vice Principal in Government Industrial Training Institute.

2] Having heard the learned Counsel for the Petitioners and the learned AGP for the Respondents, we find that since the Petitioners have raised a challenge to Rule 9(b)(ii) of the Rules of 2023, it would 1/2

8 WP-2660-24.doc be in the fitness of things that the Original Application itself is decided finally instead of this Court intervening at this stage. 3] Hence, without entering into merits of the challenge as raised, the Maharashtra Administrative Tribunal is requested to decide the Original Application within a period of four weeks, if it is otherwise convenient to it, from the date the copy of this order is received. It is clarified that all contentions of parties are kept open for being urged before the Maharashtra Administrative Tribunal. It would be open for the Tribunal to reconsider the matter afresh without being influenced by the findings recorded earlier.
