Mr. Shilpesh P. Patil v. The State Of Maharashtra Through The Chief Secretary
44-wp3968.2015 Hvn
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 3968 OF 2015 Mr. Shilpesh P. Patil ...
Petitioner
Versus
The State of Maharashtra ...
Respondent Mr. Sagar Joshi for the petitioner.
Mr. V.P. Malwankar, AGP "A" Panel for the respondent/State. CORAM : A.S.OKA AND V.L.ACHLIYA, JJ.
DATED : 30th OCTOBER, 2015 P.C. :- 1.
Heard the learned counsel for the petitioner and learned AGP for the respondents.
2.
The contention of the petitioner in this petition is that a representation was made on 29th October, 2014 to the State Government pointing out the alleged breaches of the terms and conditions on which an exemption was granted under section 20 of the Urban Land (Ceiling & Regulations) Act, 1976 (for short "the said Act of 1976"). The case made out in the petition is that no action has been taken by the State Government by taking recourse to Chapter III of the said Act of 1976. Considering the limited prayer, we dispose of the petition by passing the following order : 1/2
44-wp3968.2015 We direct the respondent to decide the representation dated 29th October 2014 (Exh. "E" to the petition), if not decided till today, as expeditiously as possible and in any event within the period of three months from today. It is obvious that before taking any action, the State Government shall give a notice to the persons for whose benefit the exemption under section 20 of the said Act, 1971 was granted. All contentions on merits are kept open.
