By present application, the Applicant prays for restoration of the petition, dismissed for non-prosecution. Perused the order of this Court dated 6 February 2017. Learned Counsel, by inviting my attention to paragraph 2, submitted that as the Counsel was before the Division Bench of this Court, when the matter was called out before the learned Single Judge of this Court, the Counsel was unable to attend this Court and the absence was purely bonafide and unintentional. Learned Counsel submits that the Petitioner has raised various grounds on merits in the petition. Learned Counsel, thus, prays for restoration of the petition. Learned Counsel for the Respondent opposes this prayer. Pg 1 of 2
