1) Mr. Dabke, Additional Government Pleader, states that First Appeal was dismissed for not submitting the paper-book. This application seeks restoration of Appeal. 2) Mr. Dabke, on instructions submits that, the paperbook shall be fled within three weeks from today.

In consideration of the statement, the order dismissing the First Appeal is recalled. 3) For the reasons stated in the application, the delay caused in preferring the application is condoned. Application is allowed and made absolute in terms of prayer clauses (b) and (c), which read as under : (b)that this Hon'ble Court be pleased to condone the delay of 1 year 344 days in preferring above mentioned Interim Application for Restoration of above mentioned First Appeal No.336 of 2013.

(c) that this Hon'ble Court be pleased to restore the above mentioned matter on fle and allow the applicant to fle paper book as per order dated 24.01.2019 passed by this Hon'ble Court."
