Srinivasa Rao Tamarala v. Film And Television Institute Of India Through Chairman And ANR.
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO.2570 OF 2019 Srinivasa Rao Tamarala .... Petitioner Vs.
Film and Television Institute of India & Anr.
.... Respondents Ms Aditi Saxena for the Petitioner.
Mr. Gajendra Barik, Consultant (Administration) of Respondent No.1, present in Court.
CORAM: S.C. DHARMADHIKARI & M.S. KARNIK, JJ.
DATE : MARCH 06, 2019 P.C:
1.
This matter was placed today for admission after notice to the contesting respondent No.1/Film and Television Institute of India ("FTII" for short).
2.
After this matter was argued for sometime, we gave a suggestion to both sides that, bearing in mind that FTII runs courses in film and television programme making and the
petitioner claiming to be a creative person, both sides should amicably resolve the issues. If the issue is of mis-conduct of the petitioner on a given day and time at the Institution's campus or its hostel, then, even now an apology can be tendered on affidavit by the petitioner, which shall be accepted by the first respondent and thereafter the chapter can be closed. 3.
We are happy to note that the petitioner has tendered his affidavit. He has in categorical terms and voluntarily stated that he tenders unconditional and sincere apology to the first respondent for his conduct on 19-12-2018. 4.
The FTII has authorised Mr. Gajendra Barik, Consultant (Administration) to represent it today. 5.
The letter of authorisation is signed by Mr. Bhupendra Kainthola, Director of the first respondent. In the presence of Mr. Barik, this affidavit, tendering unconditional and sincere apology, was read out and shown to him. 6.
He communicated to us that the Institute does not
hold anything against this petitioner and it would accept his apology and allow him to resume his studies. It will also allow him to occupy the premises.
7.
We hope and trust that hereafter no occasion arises for the petitioner to face any proceedings, much less any disciplinary inquiry and his conduct at the Institute would be exemplary. Equally, the Institute will not hold anything against the petitioner for what has occurred in the past. 8.
In the light of the affidavit which is accepted by us, all the disciplinary proceedings are dropped. The apology is accepted by the Institute. It shall not cause any disruption in the studies of the petitioner provided he maintains discipline expected of him.
9.
In the event the petitioner has missed out on studies in the past or even some opportunities and chances to exhibit his art, including Long Take Individual Exercises, we have no doubt in our mind that the Director and the Faculty Members would be kind enough to conduct some extra classes or grant him this
opportunity even now and belatedly, bearing in mind his conduct and his apology tendered in this Court. 10.
The writ petition accordingly stands disposed of. (M.S. KARNIK, J.) (S.C. DHARMADHIKARI, J.)
