In view of self operative order dated 24th January, 2019, the appeal was dismissed for non-filing the paper-book . The Application seeks restoration of an appeal with prayer to condone the delay caused thereof.

Heard Mrs.P.N. Dabholkar, learned AGP for the State. Ms. Jyoti Mishra, the Learned Counsel for the respondent opposed the application.

Mrs. Dabholkar, learned AGP for the State submits that the State shall file the paper-book in the Registry on or before 6th May, 2022.

In view of the statement and assurance given to the Court, the order dismissing the appeal, is recalled and First Appeal No.339/2013 is restored to the file.

Application is allowed and disposed of in terms of prayer clauses (b) and (c).
