This is a successive 2nd application with prayers for suspension of sentence and enlarging the Applicant/Appellant on bail. It is submitted by the learned counsel appearing for the Applicant that this Court by order dated 13/08/2018 allowed the Applicant to withdraw Criminal Application No.1081 of 2018 for bail with liberty to apply after a period of two years in the event the Appeal is not heard in the meantime. Hence this 2nd Application for bail.

The learned counsel for the Applicant/Appellant invites attention of this Court to the order dated 22nd October 2020 passed in Interim Application Stamp No.3290 of 2020 in Criminal Appeal No.868 of 2018 which lgc

(906) IA-834.21.odt is at page 72 of the present Appeal, and submits that he was allowed to prefer separate appeal and it was admitted.

The learned counsel appearing for the Applicant does not press this Application, if the appeal itself is listed for final hearing. In peculiar facts of this case, we deem it appropriate to set down the Appeal for final hearing in the week commencing from 11/04/2022.
