Heard learned counsel for the applicant and learned APP for the Respondent - State.

By this application, the Applicant seeks pre-arrest bail, in connection with C.R. No.267 of 2014 registered with the Kurar Police Station, Mumbai for the alleged offences punishable under Sections 498(A), 406, 323, 504, 506 of the Indian Penal Code.

Learned Counsel for the Applicant submits that the applicant got married to the complainant on 25th January, 2011 and that they have a
2/3 child from the said wedlock. It is alleged that due to quarrels between the applicant and the complainant, the complainant left the matrimonial house on 16th February, 2014. According to the complainant, the applicant had physically abused and assaulted her and had demanded money to purchase a new house and on account of the same had thrown her out of the matrimonial house. Learned Counsel for the applicant relied on a letter dated 28th July, 2014, which is annexed as Exhibit - 'D" to the application, to show that there was no demand of money. He submits that the said letter does not disclose about any demand for money by the applicant. He submitted that it was only on 14th August, 2014 that a complaint alleging the aforesaid offences came to be filed against the applicant.

Considering the peculiar facts of the case, prima-facie the applicant has made out a case for grant of pre-arrest bail on the following terms and conditions :
ORDER
i) In the event of arrest, the Applicant be enlarged on bail on furnishing P.R.Bond in the sum of Rs.15,000/-, with one or two sureties in the like amount ;
3/3 ii) The Applicant shall attend the Kurar Police Station, Mumbai, on every Sunday, between 10.00 a.m. to 11.00 a.m., till the filing of the charge-sheet ; iii) The Applicant shall not tamper or attempt to influence the witnesses or any persons concerned with the case ; 5.
The Application is allowed and disposed of in above terms. 6.
