This is an application for anticipatory bail in CR No.1033 of 2020 registered with Goregaon Police Station for offences under Sections 353, 323, 363, 341, 143, 146, 149, 504, 34 of Indian Penal Code. On 9th November 2020 the Municipal officers were carrying out work relating to toilet on CTS No.746/13. At that time mother of the applicant formed unlawful assembly by calling other women. The officers on duty were abused and threatened. The applicant came there and threw paver block lying on the spot on the policemen. Fortunately the officer could avoid the hurt. Other accused were arrested and granted bail.

From the documents it appears that investigation is almost complete. Mother of the applicant was arrested. She has been granted bail. The FIR indicates that applicant had visited the spot to question the police as to why his mother was being taken away.

Learned APP submitted that the incident is serious. The applicant tried to assault policeman on duty. There are criminal antecedents against mother of the applicant.

It is pertinent to note that other accused who were arrested are granted bail. It appears that the applicant's mother and other women were protesting against action of Corporation. There are no criminal antecedents against applicant. In the circumstances, applicant need not be subjected to custodial interrogation. Hence, I pass following order :

ORDER

(i) The application is allowed and disposed of;

(ii) In the event of arrest of applicant in connection with CR No.1033 of 2020 registered with Goregaon Police Station, the applicant be released on bail on his executing PR bond in the sum of Rs.25,000/- with one or more sureties in the like amount; (iii) The applicant shall report Investigating Officer on 24th and 25th March 2021 between 11 am and 1 pm and shall co-operate with investigation.
