In furtherance of the earlier order, the learned A.P.P. has placed on record current medical report of the Applicant's wife through the Assistant Police Inspector, Mhasala Police Station, Thane. The said report is taken on record and marked 'X' for identification.

As per the said report, on 13/01/2023, the wife of the Applicant was admitted in hospital on account of brain hemorrhage, but since last two months, she is at home and taking medicine as an outdoor patient. She is residing with her daughter and son-in-law for last two years. M.M.Salgaonkar

In the wake of the aforesaid scenario, since I was not persuaded to release the Applicant on bail, considering the merits of the application and, since, there is no grave medical situation as regards the health of his wife, the Applicant do not deserve his release on bail.

Application is dismissed.

However, the Applicant is at liberty to take out an appropriate application, if the trial does not commence for a considerable period of time or any other medical contingency of his wife arises, which would warrant his release on bail. 3.

In view of the dismissal of the bail application, nothing survives in the interim application and it also stands disposed off.
