This is an application under Section 439 of Code of Criminal Procedure (Cr.P.C.) for bail.

The applicant came to be arrested in Crime No. 592 of 2021 registered at Yerwada Police Station, Pune city for the ofences punishable under Sections 376, 376(2)(n), 313 and 506 of the Indian Penal Code (IPC), Sections 4, 6, 8 and 12 of the Protection of Children from Sexual Ofences Act (POSCO Act) and Section 67(B) of the Information Technology Act, 2000 (IT Act). 3.

I have heard the learned counsel for the applicant, the learned APP for the respondent - State and the learned Counsel for the respondent No.2/victim girl.

There was a love afair between the present applicant and the victim girl. The victim girl has fled an afdavit that she has no Dinesh S. Sherla 1/2

29-ba-909-22.doc objection if the bail is granted to the present applicant as they intend to marry each other. Considering the facts and circumstances, I am inclined to release the applicant on bail. In the result, the following order is passed.

O R D E R

A] Bail Application is allowed.

B] The applicant be released on bail in C.R. No.592 of 2021 registered at Yerwada Police Station, Pune city for the ofences punishable under Sections 376, 376(2)(n), 313 and 506 of the IPC, Sections 4, 6, 8 and 12 of the POSCO Act and Section 67(B) of the IT Act on furnishing P.R Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount.
