Heard. This Application is for deleting the name of Respondent No.3 from cause title of First Appeal No.1919/2009 as well as Civil Application No.1996/2013.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Civil Application is allowed in terms of prayer clause (a) which read thus:

b) That the name of the Respondent No.3 be deleted from the cause title of the First Appeal No.1919/2009 and Civil Application No.1996/2013 and the Respondent nos.4 and 5 be numbered as Respondent Nos. 3 and 4.

b) Civil application stands disposed off accordingly.

c) Place the First Appeal No.1919/2009 with Civil Application No.1996/2013 on board after 6 weeks.
