This is an Application under section 438 of Cr.P.C. filed by the aforesaid Applicant who is apprehending his arrest in C.R.No.48/2021 registered with Hill Line Police Station, Ulhasnagar, Dist. Thane for offences punishable under sections 143, 147, 148, 307, 323, 326, 341, 504, 506 r/w. 34 of the Indian Penal Code.

Heard Mr. Nitesh Mohite, learned counsel for the Applicant and Mr. S.H. Yadav, learned APP for the State. I have perused the records and considered the submissions advanced by the learned counsel for the respective parties.

The aforesaid crime was registered pursuant to the first information report lodged by Bhupendra Rathod. The complainant has alleged that on 28/02/2021, at about 20:00 hours, while he and his friend Kailash were standing near a pan stall, one person started abusing Kailash. When the complainant intervened, the said person called one Hritik Teji. Said Hritik Teji and two other persons came to the place of the incident and started abusing and assaulting the complainant and Kailash. The first informant has stated that the coaccused - Hritik Teji assaulted him with a beer bottle. The first informant therefore lodged the complaint against said Hritik Teji and his two associates.

The medical certificates prima facie indicates that the first informant had sustained simple injuries on right occipital region which was caused by blunt object and he had sustained grievous injury on left index finger caused by sharp object. The first information report does not indicate that the Applicant was involved in assaulting the complainant with the beer bottle or causing any of these injuries. 5.
Considering the above facts and circumstances as well as the nature of injuries, in my considered view, this is a fit case for grant of 2/3
pre-arrest bail. Hence, the Anticipatory Bail Application is allowed on following terms and conditions :- (a) In the event of arrest of the Applicant in C.R.No.48/2021 registered with Hill Line Police Station, Ulhasnagar, Dist. Thane, he shall be released on bail on furnishing bail bonds in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one or two sureties in the like amount ;
(b) The Applicant shall report to the Investigating Officer for a period of four days from 21/03/2022 to 24/03/2022 between 11:00 a.m. to 02:00 p.m.
(c) The Applicant shall keep the Investigating Officer informed of his current address and mobile contact numbers, and/or change of residence or mobile details, if any, from time to time.
