DATED : 11th MARCH, 2022 P.C:- The applicants are apprehending their arrest in the subject C.R.No. I-966/2021 registered on 4/9/2021 with Waliv police station, invoking offence punishable under Section 138 of the Electricity Act, 2003, and Section 427 of the IPC. Undisputedly Section 427 is bailable. The reading of the complaint lodged by Jr. Engineer of Mahavitaran Company, who reveal that on inspection of the premises by the flying squad, the premises were owned by one Praful Lokhande and leased out to M/s.Amafhh Glass Tuff, the applicants are alleged to be the partner in the said enterprises.

2/3 13 ABA 655-22.doc The meter came to be seized on 25/8/2021 and the allegation levelled is that the wire was cut, since the two cables were terminated. In the wake of the aforesaid allegations, the C.R. came to be registered.

Looking to the nature of the accusations faced by the applicants, the custodial interrogation of the applicants is not necessary provided they co-operate with the investigation and which assurance comes from the counsel for the applicants. Hence, the following order :-

O R D E R

(a) In the event of his arrest, the Applicant no.1 Huzefa Abdulla Aamir and applicant no.2 Huzefa Shabbir Azad in connection of C.R.No.I966/2021 registered with Waliv police station shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- each, with one or two sureties of the like amount.

(b) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade them from disclosing the facts to Court or any Police Officer and should not tamper with evidence.
