The learned counsel for respondent no.1 submits that the present petition is filed by the defendant No.1 in Regular Civil Suit No.2229 of 2012. That the respondent No.1 is the plaintiff. The learned counsel for respondent No.1 submits that the suit has been decreed in favour of the plaintiff by a judgment and order dated 29.9.2016 and that the defendants have filed an appeal before the appellate Court.
