The learned counsel for the Petitioner submits that Petitioner is allotted alternate land being Project Affected Person. However, the occupancy price charge is too exorbitant.

The learned counsel submits that for another land in the same gut no. occupancy price charge is Rs.6,42,000 for 40R land whereas Petitioner is charged the amount of Rs.55 lacs and odd. For 1 H 20R, Petitioner has made representation to the authority on 28.1.2022. (page 96). Mohite 1/2

We have heard the learned A.G.P.

As the Petitioner has already approached the authority, the authority shall take decision upon the representation of the Petitioner with regard to the valuation of the occupancy price on its own merits preferable within 3 months.

Needless to state that the authority shall consider all the relevant aspects of the matter such as Petitioner being Project Affected Person, land is agricultural land, ready reckoner rates and so also, the occupancy price of other properties. Same shall be considered on its own merits by the authority concerned.

Writ Petition is disposed of. No costs.

Petitioner made appear before the authority on 27.04.2022.
