This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail. 2.

The applicant is apprehending his arrest in Crime No. 60 of 2022 registered at Uran Police Station, for the offences punishable under Sections 420, 506 of Indian Penal Code.

I have heard the learned Counsel for the applicant and the learned APP for the State.

According to the complainant, co-accused in the present crime, namely V. Narsimha Rao accepted Rs.12,75,000/- from him Kanchan P Dhuri 1 / 2

22-ABA-663-2023.odt towards purchase of second hand vehicles and refused to deliver the said vehicles to him. According to the complainant, the present applicant had proposed to him to purchase the vehicles from the said co-accused. 5.

There are no allegations of cheating against the present applicant. Considering the overall facts and circumstances of the case, I am inclined to grant anticipatory bail to the present applicant. In the result, the following order is passed :

(i) Application is allowed.

(ii) In the event of arrest of the applicant in Crime No. 60 of 2022 registered at Uran Police Station, for the offences punishable under Sections 420, 506 of Indian Penal Code, he shall be released on bail on furnishing P.R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount.

(iii) Applicant shall attend the concerned police station as and when called by investigating officer and shall co-operate in the investigation.
