In view of the statement made by learned APP, on instructions, the learned counsel for the applicant does not press the application and seek

Application is accordingly disposed of as withdrawn with liberty as prayed.

It is made clear, that the application is not been considered on merits and if an application, after filing of the charge sheet is filed, the same shall be considered on its own merits, uninfluenced by the withdrawal of the aforesaid application.
