On the complaint of petitioner, the Investigating Officer communicated to Siddharath Developers and Builders indicating that the petitioner may resort to remedies under Section 138 of the Negotiable Instruments Act. Learned APP submits that the police has closed the matter as they have decided not to take cognizance. 2.

If this is the case, then the police need not advise the petitioner as to whether petitioner should approach a particular forum for redressal of his grievances.

In the facts, petitioner is at liberty to resort to appropriate remedy under Cr. P. C.
