Mr Thorat, on instructions from the appellant who is present in court, seeks to withdraw the appeal. The appeal is dismissed as withdrawn. This is without prejudice to the rights and contentions of the appellant in regard to the jurisdictional issue. The civil application does not survive and it is disposed of as infructuous. 2.
The Trial Court is requested to dispose of the suit as early as possible and to encourage the parties to settle the dispute amicably, they being brother and sister, and the dispute being one in relation to their father's estate.
