Heard. This Application is for amendment in the cause title to show the correct name of the Appellant as per order dated 15.01.2010 passed in the amalgamation proceedings.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, we are satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Civil Application is allowed in terms of prayer clauses (a) & (b) which read thus:

4.946.18-caf.doc "(a) That this Hon'ble Court may be pleased to allow the substitution of present Appellant with the proposed Appellant in the present First Appeal / pleadings filed before this Hon'ble Court. (b) That this Hon'ble Court may be pleased to allow consequential amendments and to add the proposed paragraph(s) pursuant to the substitution of the name of the present Appellant with the proposed Appellant in terms of the schedule appended hereto."

b Amendment to carried out within six weeks from today, failing which the Civil Application shall stand dismissed without further reference to the court.

c If amendment is carried out within stipulated time as stated hereinabove, the Applicant to provide an amended copy of the First Appeal to other side immediately thereafter.
