After the Appeal from Order was heard at length for some time, it was stood over to todays' date with a view to enable learned counsel for the Appellant to take instructions from his client whether he proposes to press the Appeal from Order.

Learned counsel informs the Court today that his client proposes to withdraw the Appeal from Order. However, his client seeks liberty to renew its application for ad-interim reliefs after placing before the Court

902- AOST 6139 of 2019 further material which has become available after the impugned order was passed. Learned counsel for the Respondent has no objection if this course being adopted.

Accordingly, the Appeal from Order is disposed of as withdrawn. The Appellant shall at liberty to renew its application for ad-interim relief after filing an additional affidavit in support of its application. The Respondent may file its reply to the additional affidavit within two weeks of the affidavit being served on the Respondent. Ad-interim application, if and when it is made or renewed, shall be decided by the City Civil Court expeditiously and on its own merits, without in any way being influenced by the observations made by the Court in the impugned order as well as in the interim order passed by this Court in the Appeal from Order.
