For the reasons being recorded separately, the Writ Petition No.2941 of 2016 is dismissed.

Ms.Buch, learned counsel appearing for the petitioner seeks continuation of the protection granted by the Industrial Court. Mr.Talsania, learned senior counsel appearing for the respondent opposes this application on the ground that no protection was granted by the Industrial Court. He, however on instructions, states that the respondent will not take any disciplinary action against the petitioner for a period of five weeks from today for not reporting duty to Sanjan-Vapi. Statement is accepted.

In view of the statement made by the learned senior counsel for the respondent, application made by the learned counsel for the petitioner is rejected.
