I have considered the submissions of the learned counsel for the respective sides and have gone through the various orders passed in the proceedings in hands, by the learned Single Judge Bench as well as the learned Division Bench. 2.

The learned counsel for the respondent/original petitioner submits that pursuant to the earlier orders, the applicant is at liberty to withdraw the accrued interest and back wages deposited, which are retained in this Court. So also, he prays that the writ petition be taken up for fnal hearing, since it is pending for almost 13 years. M.M.Salgaonkar

In view of the above, this application is allowed in terms of prayer clauses (a) and (b), which read as under :- "a) Allow the applicant to withdraw the amount of interest accrued on the principal amount of back wages deposited by Respondent every 6 (six) months; b) Be pleased to continue the interim Order passed in Civil Application no.331 of 2013 in Letters Patent Appeal no.247 of 2010 pending the hearing and fnal disposal of the present Writ Petition."

Needless to state, the back wages deposited in this Court would be retained as per the earlier orders.

List Writ Petition No.886 of 2009 for fnal hearing on 22/02/2022.
