The learned counsel for the petitioners fairly submits that the petitioners herein happen to be the original defendants in RCS No.97 of 2007. An application under Order XXXIX Rule 1⁄2 was granted in favour of the original plaintiffs. The same was confirmed by the appellate Court. The suit has proceeded substantially. Hence, the prayers in the Petition have become infructuous. However, it is made clear that this Court has not gone into the merits of the matter. All contentions are kept open. Petition stands disposed of.

The learned Court seized with the matter is hereby requested to make an endeavour to dispose of the suit expeditiously and, in any case, on or before 28.2.2018.
