Heard the learned counsel for the Applicant and the learned APP for the Respondent - State.

By this application, the Applicant seeks modification of the order dated 12th January, 2015, passed by this Court (Coram:P.D.Kode,J.) in Criminal Bail Application No.44 of 2015, in particular para 10 of the order, inasmuch as, it directs the release of the applicant on P.R. Bond in the sum of Rs.1,00,000/- (Rupees One Lakh only) with one or more sureties to make up like amount. The modification of the order sought

2/3 reads as under ;- "10.

........ The applicant is directed to be released on bail in above said crime number on furnishing P.R. Bond in the sum of Rs.1,00,000/- (Rupees One Lakh only) with one or more sureties to make up like amount ..... " 3.

Learned Counsel for the applicant submitted that the applicant is not in a position to arrange for such a huge amount as the applicant's husband is poor and illiterate. He submits that the applicant's husband has retired from B.M.C., and is managing on the meagre pension and therefore the said amount be reduced.

Learned APP states that she has no objection if the order is modified to the above extent.

Accordingly, for the reasons set out in the application, following order is passed : -

ORDER

(i) Resultantly, the application is allowed. The applicant is directed to be released on bail in above said crime number on furnishing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousan only) with one or

3/3 more sureties to make up like amount instead of P.R. Bond in the sum of Rs.1,00,000/- ;

ii) The rest of the conditions imposed vide order dated 12th January, 2015, to remain as it is.

The application is accordingly allowed in the above terms. 7.
