Though respondent no.2 is duly served, no one appeared on behalf of them when the matter was called out.

This application is preferred by claimant for condonation of 82 days delay in filing First Appeal challenging the judgment and award dated 5.8.2013 passed by MACT, Mumbai in Application No.1418 of 2008.

Considering the submissions made by the learned counsel for the Applicant and the averments in Civil Application, I am satisfied that the Applicant has made out a case for allowing the Mohite 1/2

a) Delay of 82 days in filing the First Appeal challenging the judgment and award dated 5.8.2013 passed by MACT, Mumbai in Application No.1418 of 2008 is condoned.

b) Civil application stands disposed off accordingly.
