IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 10041 OF 2015 Pipe Arts India Pvt. Ltd., Sanaswadi ... Petitioner v/s Shri Hemraj Ramkrishnaji Kinnarkar ... Respondent Mr.T.R.Yadav for the petitioner.
None for the respondent.
CORAM: N.M. JAMDAR, J.
DATED : 16 FEBRUARY 2016 P.C.:
The Petitioner challenges the Award passed by the Labour Court, Pune, dated 24 January 2012. By the impugned award, the Labour Court has directed the Petitioner to pay 25% back wages of the period of six months to the Respondent workman. Learned counsel for the Petitioner has submitted that the impugned Award has been passed without considering various documents and admissions on record and that Respondent is gainfully employed. It is informed that the back wages would be at the rate of Rs.4,000/- per month, and 25% would be Rs.1,000/- per month. Writ jurisdiction of this Court is invoked challenging grant of Rs.6,000/- to the workman. It is not for every error that a writ
bsb 2 21.WP10041.15.doc must issue. The Labour Court has considered the facts and circumstances and has passed an equitable order directing the payment of 25% back wages. No case is made out for exercising extraordinary jurisdiction of this Court to interfere with the impugned order.
The writ petition is accordingly rejected.
