This application is moved under section 438 of Criminal Procedure Code for granting pre-arrest bail as the applicant/accused is facing charges under section 307, 143, 147, 148, 149 of the Indian Penal Code. 2.

The learned Prosecutor has pointed out that the applicant/accused, at the time of the incident which occurred on 23.10.2014 at Kalewadi, Wakad, was a juvenile i.e., below 18 years of age. This plea was taken by the accused at the time of the hearing of the interim pre-arrest bail application and accordingly, this Court has noted down and directed the prosecution to verify the age certificate of the applicant/accused. 3.

In view of this, without going into merits, I direct the applicant/accused to appear before the learned Magistrate presiding over 1 / 2

aba.376.2015_4.doc the Juvenile Court and surrender before him on 30.4.2015. Till then, Interim relief, granted earlier to continue.
