The learned counsel for the respondent submits that in the present Appeal from Order the appellants original defendants challenges the order dt.14.9.2012 passed by trial court in Notice of Motion No.810 of 2012 rejecting appellants prayer for framing additional issues. He submits that the Appeal from Order is not maintainable against the impugned order dt.14.9.2012.

As no one appeared on behalf of the appellant, Appeal from Order is dismissed for default. In view thereof, Civil Application does not survive. The same is also dismissed.
