Mr. Limaye, learned counsel for the petitioner, on instructions, seeks leave to withdraw the petition with liberty to file representation under Section 53(3) of the MRTP Act. Leave with liberty is granted.

In the event the petitioner files such representation within a period of two weeks from today, respondent No.2 Municipal Corporation shall decide the same within four weeks thereafter. 3.

In case, the decision of respondent No.2 goes adverse to the interest of the petitioner, the same shall not be implemented for the period of two weeks thereafter.

It is made clear that we have not gone into the merits of the matter and all points and contentions of the respective parties are expressly kept open.
