1) This is an application for condonation of delay of 288 days in filing the application for leave to file appeal against the order of acquittal of the respondent no.2. The learned counsel for the applicant submitted that the respondent no.2 is duly served and he has filed affidavit of service in that behalf. The respondent No.2 has acknowledged the notice issued by the learned counsel for the applicant on 1.7.2016. 2) The respondent no.2 is absent though duly served. 3) For the reasons stated in the application and in the interest of justice, the application is allowed. The delay is condoned. 4) Application is allowed in aforesaid terms.
