This is an application for suspension of sentence and releasing the applicants/accused on bail during pendency of the appeal filed by them. The applicants/accused are convicted of offence punishable under Sections 332, 353, 504 and 506 of the Indian Penal Code. Different sentences are imposed on different counts, the highest amongst them being the sentence of rigorous imprisonment for two years for the offence punishable under Section 332 of the Indian Penal Code. The learned trial Court has directed that substantive sentences shall run concurrently. Gaikwad RD 1/2
(7)APPANo.3172019.doc Heard the learned Counsel appearing for the applicant/accused as well as the learned Additional Public Prosecutor.
Short sentence of imprisonment imposed on the applicant/accused has already suspended by the learned trial Court. The applicants/accused were on bail during the trial and they have not misused their liberty. The fine amount is already deposited by them. Hence, the Order :
ORDER
(i) The substantive sentence of imprisonment imposed on the applicants/accused is suspended and they are directed to be released on bail on their executing P. R. Bond of Rs.15,000/- each and on furnishing surety in the like amount by each of them.
(ii) As a condition of this Order, the applicants/accused should not contact the victim of crime in question or her relatives in any manner and they should not repeat commission of similar offence in future.
(iii) The application is disposed of accordingly. (A.M.BADAR J.) Gaikwad RD 2/2
