At the outset, learned APP states on instructions that during the pendency of this application, charge-sheet has been filed, as against the applicant, in the said case.

In view of the statement made by learned APP, on instructions, the learned counsel for the applicant does not press this application and seeks leave to withdraw the same with liberty to file a fresh application,
2/2 21-ba.547.2018.doc after filing of the charge-sheet, before the appropriate Court. 3.
Learned Counsel for the applicant also seeks leave to file an application seeking temporary bail on the ground of death of the applicant's father. Leave granted.

Application is accordingly disposed of as withdrawn with liberty as prayed.

It is made clear, that if such an application seeking temporary bail is filed, the learned Judge shall decide the same as expeditiously as possible, on its own merits. Similarly, if an application for regular bail is filed, after filing of the charge sheet, the same shall be decided by the learned Judge, on its own merits, uninfluenced by the withdrawal of this application.
