PIL. 64-13 VPH
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION PUBLIC INTEREST LITIGATION No. 64 OF 2013 Dr. Rajendra Pralhad Patil ...
Petitioner Vs.
The State of Maharashtra, Through Secretary, Education Dept.
& Ors.
...
Respondents *** Mr. Machhindra A. Patil, for the Petitioner.
Mr. N. C. Walimbe, AGP for Respondent.
*** CORAM : V. M. KANADE, & P. R. BORA, JJ.
DATE : FEBRUARY 6, 2017 PC.
1.
Heard the learned counsel appearing on behalf of the Petitioner and the learned AGP appearing on behalf of the Respondent - State. The Petitioner, initially, had filed this PIL, alleging that there are several unauthorised secondary schools in Solapur district. Thereafter, the Petitioner has expanded the scope of the PIL, seeking direction, directing the Government to verify whether all the schools 1 / 2
PIL. 64-13 in the districts of Maharashtra are authorised. 2.
To the first prayer, the Respondent-State have filed affidavit in reply dated 17.4.2013. In the said reply, they have stated that they have taken action against the schools, which are being run unauthorisedly. The Government has issued a Government Resolution dated 20.8.2012, and thereafter the Government has changed its policy in respect of 43 primary and secondary schools. We find that the stand taken by the Petitioner is without any substance. The PIL, therefore, has actually worked out.
3.
Thereafter the petition is seeking to expand the scope of the PIL contending that several schools all over the Maharashtra are illegal and bogus schools. We are not inclined to pass any omnibus order, directing the Government to reverify whether schools are being run illegally / unauthorisedly. Needless to say that if any specific instance is pointed out by the Petitioner, the same may be considered expeditiously on merits and in accordance with law. Public interest litigation is, accordingly, disposed of in the aforesaid terms. Sd/- Sd/- [P. R. BORA, J.] [V. M. KANADE, J.] Vinayak Halemath 2 / 2
