Petitioner submits that representation filed by the petitioner, annexed at Exhibit "C" to the petition, has not been replied. Learned counsel appearing for the CIDCO submits that the old construction has been already demolished and for a new construction, the petitioner ought to have applied for permission.

Without prejudice to the rights and contentions of the contesting parties, we observe that the CIDCO authorities may reply to the representation submitted by the petitioner on its own merits. 3.
