The challenge in this petition is to the order dated 28.06.2006 passed by the learned Judicial Magistrate First Class at Nashik in Inquiry Application No. 152 of 2005. By the impugned order, the learned Magistrate has granted maintenance @ Rs.1500/- per month to the Respondent wife, from the date of application. The Petitioner-husband is seeking to challenge the said order after a period of 16 years, that too without first approaching the learned Sessions Judge in a revision application under Section 397 of Cr. P.C.

The contention on behalf of the Petitioner is that the Respondent is not his wife. I am afraid the contention cannot be accepted. As noticed earlier there is a substantial delay in Sneha Chavan page 1 of 2

The petition is without any merit and is accordingly dismissed, in limine.
