Hence, the Appeal from Order is dismissed as withdrawn with liberty as prayed for.

In view of withdrawal of the Appeal from Order, nothing survives in the Civil Application, if any. Same stands dismissed as infructuous.

The Trial Court to decide the Application that may be filed by the Appellant on its own merits, without being influenced by the present order.
