Appellant - convict was directed to be released on bail by this Court vide order dated 26th July, 2018 on certain terms and conditions. What appears from the proceedings is that, he failed to comply with the condition on which, he was enlarged on bail. 1/2

5.Cri.IA 973-2020 w I.A.1402-2020 in Appeal 889-2018.doc Resultantly, non-bailable warrant was executed on 17th December, 2019 and since then, he has been incarcerated for almost for more than a year, against sentence of three years. Learned Counsel for the Appellant undertakes, on instructions that if released, the applicant shall abide by all the conditions. Undertaking is accepted.

In view of the Undertaking and in consideration of the fact that he is in jail for more than a year as against the sentence of three years, application is allowed and appellant is directed to be released on bail on executing P.R. bond in the sum of Rs. 25,000/- with one or more sureties in the like amount. 3.

The appellant shall report to the Registrar of the concerned Court, once in a month i.e. 1st Monday of each month, commencing from February, 2021 between 11 am. to 01 pm.

Application No.973/2020 is allowed and disposed of in the aforesaid terms.
