In this case, there is sufficient explanation for delay in paragraph 2 of the application. The Insurance Company should have been more diligent in preferring the appeal. However, the delay can always be condoned by imposition of costs.

In this case, there was some issue of establishment of new office and transferring of files. For all these reasons, the delay is condoned subject to payment of costs of Rs.5,000/-. The payment of costs is the condition precedent. The Civil Application is disposed of accordingly.
