By the above Miscellaneous Civil Application filed under Section 24 of the Code of Civil Procedure, 1908, the Applicant-wife seeks transfer of Petition being No. A-749 of 2016 filed by the Respondent-husband pending before the Family Court at Pune to the Family Court at Nashik.

The Respondent is present in Court. He states that he has no objection if the proceedings in Petition being No.A-749 of 2016 filed before the Family Court at Pune is transferred to the Family Court at Nashik. In view thereof, following order is passed:- (a) The Petition being No. A-749 of 2016 filed by the Respondent-husband is directed to be transferred from the Family Court at Pune to the Family Court at Nashik.
kpd 2 / 2 912-MCA-80-2017.sxw (b) The Registrar, Family Court at Pune shall ensure that the papers and proceedings of Petition No. A-749 of 2016 reaches the Family Court at Nashik, on or before 5 th October, 2017.
(c) The parties and/or their Advocates shall appear before the Family Court at Nashik on 9 th October, 2017 at 11.00 a.m. and obtain appropriate orders. (d) The Family Court at Nashik shall endevour to dispose off the Petition being No.A-749 of 2016 within a period of six months from the date of this Order. (e) The parties shall not seek adjournment/s unless absolutely necessary. The Family Court at Nashik shall also not grant adjournment/s to either side unless absolutely necessary.
(f) The parties as well as the Family Court at Pune and Family Court at Nashik to act on an authenticated copy of this Order.
(g) All contentions of the parties are kept open. 3.
