Normally this Court would not have granted indulgence in extending the temporary bail granted to the Applicant by the Special Court. The Special Court under the MCOC Act had granted temporary bail to the Applicant on 14.07.2021 initially for a period of one month on the ground that the father of the Applicant is suffering from blood cancer and was required to be looked after, inasmuch as the mother of the Applicant was also not well. That order has been extended on 20.08.2021 and 13.12.2021.

The learned Special Judge by an order dated 09.03.2022 has refused to grant further extension and has directed the Applicant to surrender today.

I have heard learned counsel for the parties. 4.
The latest report from Sassoon Hospital, Pune dated 07.02.2022, which has been taken note by the learned Special Judge, shows that the father of the Applicant has been operated for the rectal cancer and has been advised rest for two months. He has also been advised blood transfusion.

The learned counsel for the Applicant submits that some time is required to the Applicant to make alternate arrangement of a caretaker, who can look after the father of the Applicant as according to the learned counsel, the mother of the Applicant is not still well. However, there is no medical report of mother on record to indicate that she is unable to take care of her husband. Be that as it may.

Considering the circumstances and the ground made out, nature of ailment and the report from Sassoon hospital, the period for surrender is extended till 01.04.2022. 7.
The criminal application is disposed of.
