1] Mr.Nargolkar, the learned counsel for the petitioner, on instructions, submitted that, in view of the deliberations took place in this Court on earlier occasion, the petitioner has filed Special Civil Suit No.1 of 2019 in the Court of Civil Judge Senior Division, Diu, for declaration, injunction and for other consequential reliefs. He further submitted that, a separate application for interim relief below Exhibit5 1/2
osk 39wp63192018.odt has also been filed in the said proceedings. That the said application is pending for passing appropriate orders in that behalf. He submitted that, in view thereof, he has instructions to withdraw the present petition. He, therefore, seeks leave to withdraw the present petition.
Leave granted.
2] Petition is disposed off as withdrawn.
3] The Order of adinterim relief, granted by this Court on 4th April 2019, shall remain in force for a period of eight weeks from today. 4] The learned Civil Judge Senior Division, Diu, is hereby requested to decide the application filed below Exhibit5 for interim relief by the petitioner within a period of eight weeks from the date of receipt of the present Order.
