Heard the learned counsel for the parties.

In view of the response filed from time to time to the petition, it is time to terminate the proceedings in the petition. The necessity of approaching this Court by the petitioner was

2 5.63.14 pil.doc the outbreak of typhoid in the year 2014 in Khed-Rajgurunagar. The area was under the jurisdiction of Grampanchayat which had set up a network to supply drinking water to the inhabitants of the area. As the population grew, Rajgurunagar Municipal Council was formed and took over the water distribution system.

An affidavit filed by the first respondent on 12/11/2014 informs the Court that it was the duty of the Grampanchayat to filter the water and thereafter distribute the same. It has been stated in the affidavit that Kadus Regional Water Supply Scheme for Rajgurunagar village has been sanctioned and once the scheme is implemented, water would be supplied through the network established. It is pleaded that the scheme was handed over for implementation on 19/10/2011 to the Grampanchayat and with the constitution of the Municipal Council, the Council took over the responsibility to ensure that filtered water is distributed to the inhabitants of the villages. An additional affidavit filed by the Tahsildar on 20/11/2014 informs the Court that shortcomings in the purification equipment installed were detected and removed by ensuring chlorination of the water. It was

3 5.63.14 pil.doc also ensured that alum is used to treat the water. As per the affidavit, water supply pipeline required repairs to remove leakages so that subsoil water does not percolate inside the pipes. It is pleaded that necessary repair work has been carried out. It is pleaded that water samples sent to the Government Laboratory in Pune and tested as per standards prescribed for water to be declared fit for human consumption it was reported that the water being supplied is fit for human consumption.

Learned counsel for the petitioner affirms the fact that after the typhoid broke in the area in February 2014, there have been no cases of typhoid in the villages where water is now being supplied through the distribution system which has been upgraded. Thus, the object of the petition being achieved, we terminate the proceedings by closing the file and directing the Registry to send the file to the record room. Petition is disposed of.
