By this writ petition, the petitioner has challenged the order of the Debt Recovery Tribunal, Pune in recovery proceedings No.304 of 2002 and the judgment and order passed by the respondent no.7 dated 14.10.2003 in Appeal No.12 of 2003. Though initially, this Court had granted ad-interim relief in favour of the petitioner, the ad-interim order was vacated by an order dated 8.1.2008. Thereafter, when the matter was listed before the Court, none had appeared on behalf of the petitioner. It further appears from the office order dated 27.4.2009 that the writ petition stood dismissed against the un-served respondents.

RNG 2/2 8793.03 In view of the order dated 4.4.2009 vacating the interim relief, it is most likely that the petitioner must not be interested in prosecuting the writ petition. None appears on behalf of the petitioner today.

In the aforesaid set of facts, we dismiss the writ petition with no order as to costs.
