This is a subsequent application seeking enlargement on bail. The earlier application was withdrawn before this court, after the court had expressed it's opinion that it was not inclined to allow the application. The same was withdrawn on 5th January 2017. Learned counsel for the applicant submits that the applicant herein is in custody since 9th March, 2014 and that the trial in MCOC Case No. 4 of 2014 is proceeding at a snail's pace. As on today, 10 to 15 witnesses are examined. It is specifically submitted that the applicant is not produced from Jail at the stipulated time.
Dusane 2/2 42 ba 556.2018.doc The hearing of the special case therefore is either adjourned or cannot be completed on the same day. It appears that the delay is on account of non-production of the accused. The accused is in Taloja Central Jail. The prosecution shall see to it that the accused is produced before the Court at 11.00 am.. The A.C.P., Santacruz Division as well as Jail Authorities shall see to it that the accused is produced in time.
The learned Special Court seized with MCOC Case No. 4 of 2014 shall make every endeavour to expedite the trial as far as possible.
Office to communicate this order to the concerned A.C.P. of Santacruz Division as well as to Taloja Cental Jail forthwith. With these observations, the application stands disposed of.
