CIVIL APPELLATE JURISDICTION REVIEW PETITION (ST.) No. 6845 OF 2018 IN F.A. No. 690/2014 WITH CIVIL APPLICATION (ST.)NO. 6848 OF 2018 IN REVIEW PETITION (ST.) No. 6845 OF 2018 IN F.A. No. 690/2014 Dilip Moreshwar Mone ... Petitioner Vs.

Girish Balkrishna Dandekar & Anr.

... Respondents Mr. Syed S. Abbas Naqvi, Advocate for the petitioner/applicant. Mr. Mohan D. Samel, Advocate for the respondents. CORAM: MRS.MRIDULA BHATKAR, J.

DATE: 13th April, 2018.

P.C.:

This Review Petition is filed against the judgment and order dated 1st February, 2018 in First Appeal No. 690 of 2014. 2.

The learned counsel for the petitioner submitted that in paragraph 7 of the said judgment and order, there are two factual errors, which are required to be corrected:

(i) In line No. 8, the sentence "My attention is drawn to the written statement of the appellant wherein in paragraph 21" is not factually correct, as the written statement of the appellant was shown from the proceedings in the Cooperative Court and it is in paragraph 2.1. 1 / 3

(ii) In line No. 4 from bottom, the sentence "however, he did not remember that he received further cash of Rs.7,000/- towards interest" is not correct, as instead of cash of Rs.7,000/-, the words "cheque of Rs.7,000/-" should have been written.

3.

The learned counsel for the respondent has no objection in making corrections in the judgment and order dated dated 1st February, 2018.

4.

Considered the submissions. These corrections are in fact in the nature of speaking to minutes. In the order dated 1st February, 2018, the following corrections are to carried out: (i) In paragraph 7, line No. 8, the sentence "My attention is drawn to the written statement of the appellant wherein in paragraph 21" is substituted as "My attention is drawn to the written statement of the appellant from the proceedings in the Cooperative Court wherein in paragraph 2.1".

(ii) In paragraph 7, line No. 4 from bottom, the sentence "however, he did not remember that he received further cash of Rs.7,000/-" is substituted as "however, he did not remember 2 / 3

that he received further cheque of Rs.7,000/-". 5.

With this, Review Petition is disposed of.

6.

Civil Application is also accordingly disposed of. (MRIDULA BHATKAR, J.) 3 / 3
