Heard learned Counsel for the parties.
This application is for stay of operation and implementation of judgment and award dated 03.07.2002, passed by the M.A.C.T. Ratnagiri in M.A.C.P. No. 3 of 2002.
Office note shows that appellant has deposited the awarded amount as per order dated 04.06.2003 passed by this Court.
Considering the submissions made by the learned counsel for the Applicant, the averments made in the Application and as the applicant deposited the entire amount, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

i) Civil Application is allowed in terms of prayer clause (a) which read thus:
"a) That pending admission and disposal of the above appeal against the judgment and award passed by the Motor Accident claims Tribunal, Ratnagiri in Motor Accident No. 2 of 2002 dated 03.07.2002 be stayed."
ii) Liberty granted to the respondents claimants to take out appropriate application, if they so desire, for withdrawal of the amount and that application will be decided on its own merits. iii) Civil Application is disposed of accordingly.
