This is a petition under Article 226 of the Constitution of India for issuance of a writ of habeas corpus directing respondent no.3 to produce Aparna, daughter of the petitioner, who, according to the petitioner, has been illegally detained by the third respondent. 2.

Mr. Nalawade, learned counsel for respondent nos.1 and 2, on instructions from PSI Kale, Daman Police Station, who is present in court, states that respondent no.3 has been arrested and the daughter of the

wp-992-15 petitioner has been restored back to the custody of the petitioner. Learned counsel for the petitioner also states that in the light of the said fact, the relief which the petitioner has prayed for in this petition does not survive for consideration.

Accordingly, this petition is dismissed as infructuous with no order as to costs.
