As this application is sent by the applicant/accused from jail, seeking his release on bail, Shri.Ganesh Mohite, the learned Advocate on the Panel of Legal Aid prepared by this Court is appointed to represent the applicant/accused. Heard Shri.Mohite, the learned Advocate appearing for the applicant/accused. He argued that the applicant is languishing in jail since long and even this Court vide Order dated 2nd December 2016 has directed the learned trial Court to expedite the trial.

(10)BANo.6092017 The learned Additional Public Prosecutor, on instruction from the Investigating Officer, has informed that by now, in all ten witnesses have been examined and only three or four witnesses will be examined and then the trial can be concluded. The statement so made, on instructions, is accepted. Considering the fact that the trial is at the fag end, the following Order :
(i) The application is disposed of with direction to the learned trial Court to expedite the hearing of the trial of Session Case No.186 of 2014 pending on the file of the learned Additional Sessions Judge, Borivali Division, Dindoshi, Mumbai and to dispose of the same within three months from today.
(ii) The prosecution to take all necessary steps for examining their witnesses immediately.
(iii) Parties to act on authenticated copy of this Order. (iv) Registry is directed to send copy of this Order to the applicant in jail.
